La voce latina ARBITER, termine giuridico di antica attestazione, rimasto per molto tempo una crux etymologica per i linguisti e un enigma per gli storici del diritto romano antico per via della sua accertata estraneità all'ambito processuale delle origini, è riportata al contesto inter-etnico del commercio del Foro arcaico, dove agiva un sensale intermediario e garante di origine punica. La voce latina è spiegata come grammaticalizzazione della denominazione di un funzionario cartaginese ('rb) che presiedeva per consuetudine e poi per legge alle compravendite tra stranieri e Romani. La figura stragiudiziale venne recepita precocemente nel diritto del Pretore.
