Der Autor zeigt gegen Luhmann, daß das Kunstsystem kein Funktionssystem im herkömmlichen Sinne ist wie etwa das Wirtschafts- oder das Wissenschaftssystem. Vielmehr handelt es sich beim Sozialsystem Kunst um ein Reflexionssystem, das einer "gegensystemischen" Codierung folgt: einer Codierung, die dem Geiste der Avantgarde entstammt und im System Widerstand gegen das System zu erzeugen vermag. Erst der Wahrheitsbezug der Kunst stellt jedoch sicher, daß das Kunstsystem in diesem Modus arbeitet und künstlerische Innovationen nicht bloß simuliert werden. Die permanente Frage nach der Wahrheit der Kunst immunisiert das Kunstsystem mithin gegen seine ihm inhärente Tendenz zur selbstprogrammierten Fremdbestimmung. Diese Einsicht bildet den Ausgangspunkt für eine philosophische Ästhetik nach Luhmann.
