La refondation institutionnelle de l'organisation continentale africaine au début des années 2000 s'est accompagnée, sur le plan normatif, de l'affirmation de dispositions sanctionnant le non-respect de son droit. Or, l'existence de telles normes dans le cadre africain était loin d'être acquise. L'Organisation de l'Unité Africaine a tenté, certes de manière laborieuse, de fonctionner et d'œuvrer dans le sens de l'affirmation d'un pouvoir de sanction. Néanmoins, les insuffisances liées à l'absence de mécanismes appropriés ainsi que d'autres déficiences persistantes, notamment fonctionnelles, ont eu raison de ces efforts et ont contraint à la refondation institutionnelle de l'organisation continentale africaine.
